This document
This document is a legal agreement between you, the User, and the company that operates paridedangelo.it. It governs your use of the website and, in every case, your use of the Services. A legal agreement means that once the User accepts its terms, they are binding on the User. For simplicity, User, you and your refer to you, the User, in both the singular and plural. PARIDE D’ANGELO, we and our refer to the company that owns and operates the website. Services means the features and functions available through PARIDE D’ANGELO. Contract means this document. The Contract is written in Italian. Other definitions appear in the Definitions section at the end of this Contract.
Acceptance of the Contract
To use the Services, you must accept these Terms and conditions and the Privacy Policy when registering on PARIDE D’ANGELO. If you do not accept the Contract, you cannot use the Service.
Information
PARIDE D’ANGELO is an online shop selling alcoholic beverages to consumers.
Registration, content and prohibited use
Registration
To use the Service, or part of it, Users must register by providing all information requested in the registration form truthfully and completely, and must fully accept the Privacy Policy and these general terms. Users are responsible for keeping their access credentials secure.
Account cancellation and closure
Registered Users may deactivate their accounts, request their deletion or stop using the Service at any time through the PARIDE D’ANGELO interface or by contacting the Owner directly. If these Terms are breached, the Owner may suspend or close a User's account at any time and without notice.
Content provided by third parties
The Owner does not carry out prior moderation of content or links supplied by third parties and shown on PARIDE D’ANGELO. The Owner is not responsible for that content or for its accessibility.
Services provided by third parties
Users may use services or content included in PARIDE D’ANGELO and supplied by third parties, but they must first read and accept those third parties' terms and conditions. The Owner is not responsible under any circumstances for the operation or availability of third party services.
Prohibited use
The Service must be used as stated in these Terms. Users may not:
- reverse engineer, decompile, disassemble, modify or create derivative works based on PARIDE D’ANGELO or any part of it;
- circumvent the computer systems used by PARIDE D’ANGELO or its licensors to protect content accessible through it;
- copy, store, modify, change, prepare derivative works from or otherwise alter any content supplied by PARIDE D’ANGELO;
- use robots, spiders, site search or retrieval applications, or any other automatic device, process or means to access, retrieve, scrape or index any part of PARIDE D’ANGELO or its content;
- rent, license or sublicense PARIDE D’ANGELO;
- defame, offend, harass, threaten or otherwise violate the rights of others, including rights to privacy and publicity;
- distribute or publish illegal, obscene, unlawful, defamatory or inappropriate content;
- use PARIDE D’ANGELO in any other improper way that breaches these Terms.
Sales conditions
Purchase procedure
Each order submitted is an offer to purchase products. Orders are subject to availability and the Owner's discretion to accept them. The User must select products and complete checkout after carefully reviewing and, where necessary, changing the information in the order summary. An order is placed by confirming it and is subject to payment of the price, taxes, shipping costs and payment costs shown in the order summary.
The order processing receipt is not acceptance of the order. The Contract is concluded when the Owner sends an Order Confirmation to the email address provided by the User. The Owner may decide not to confirm an order by notifying the User within 20 days of purchase, at the email address connected to the order, if one or more purchased products are unavailable. In that case, the Owner will refund the price and the shipping costs paid by the User.
Payment methods
Products purchased on the Site may be paid for by credit card, prepaid card, bank transfer, PayPal, cash on delivery and gift card. PARIDE D’ANGELO accepts VISA, MasterCard and Eurocard. Payments are processed through a secure server-to-server connection using the SSL protocol with 128-bit encryption.
PARIDE D’ANGELO does not come into contact with payment details such as credit card details. If the provider of one of these third party payment methods refuses authorisation, PARIDE D’ANGELO cannot provide the Service and is not responsible for a delay or failed delivery. Any handling costs for a payment that is not accepted will be charged to the User. A commercial invoice is issued automatically when the ordered goods are shipped. On the first purchase, the User will be asked for the information needed for the invoice, including their tax code. The User may change this information later. Each invoice is available in the Profile section.
Gift cards
A gift card is a physical card that can be purchased on paridedangelo.it and contains a code that may be used as a payment method. It can be used to purchase all products available on PARIDE D’ANGELO and to pay any shipping costs. Its value is shown on the gift card.
If the order total is higher than the gift card value, the difference may be paid with another accepted payment method. If the order total is lower than the gift card value, the remaining credit stays on the gift card and can be used for another order by entering the same code.
Prices and shipping costs
All product prices on the Site are shown in euros (€) and, unless stated otherwise, include VAT. Shipping and any other additional cost, including VAT and shown in euros, will be stated separately in the order summary before the User submits the order and in the order confirmation email.
Product prices may change without notice, but the price charged to the User is the price published on the product page when the order is submitted. The full catalogue price, called the crossed-out price, used to calculate a discount may be the public list price indicated by the supplier or the result of market research, such as the selling price in a wine shop or another retailer. The method used to calculate a crossed-out price varies by product. Crossed-out prices indicate the product's value, but the actual price in some shops may be different.
Retention of title
Until the product price has been paid in full, ordered products remain the property of the Owner.
Product availability
Displayed product prices, descriptions and availability may change without notice. Product photographs are for illustration and do not guarantee product quality. If an ordered item is unavailable, the Owner will inform the customer immediately and refund any price already paid.
Sale products
The Owner may, at its sole discretion, offer some products at a discounted price for a limited period. The conditions for each offer are shown in the information page connected to the offer. Each offer is valid until the stated expiry date and, in every case, until stock runs out.
Coupons issued by the Owner
The Owner may, at its sole discretion, offer coupons for purchases on PARIDE D’ANGELO. The Owner may exclude certain products from coupon purchases. Unless stated otherwise:
- Each coupon is valid for one User and may be used once, according to the instructions and timing shown on the website or supplied with the coupon.
- Coupons cannot be combined. Only one coupon may be used per order.
- Some coupons may be used only when the order reaches a minimum value. That value is shown on the relevant promotion page. Shipping and additional costs do not count toward the threshold.
- If applying a coupon brings the total below the free shipping threshold, shipping costs will be added.
- Coupons may not be used partially or in a way that results in full redemption over several stages.
- A coupon must be redeemed within the period stated for the offer. After that period it expires automatically, and the User cannot make a claim about it.
- Coupons are for personal, non-commercial use. Reproducing, counterfeiting or commercially exchanging a coupon, and any unlawful activity connected with its purchase or use, is prohibited.
If any unlawful activity occurs, the Owner may refuse to perform its contractual obligations and may take legal action to protect its rights and interests.
Order fulfilment
Orders are fulfilled within the time stated on the summary page and Order Confirmation email, subject to product availability. The Owner is not responsible for delivery delays caused by circumstances that the parties could not foresee when the Order Confirmation was sent.
Delivery
Delivery times are shown on each product page, during checkout and in the order confirmation email. Shipping generally takes place within 48 hours. Deliveries are made during normal working hours to the address provided by the User through a carrier throughout Italy, except Campione d’Italia and Livigno. The carrier is responsible for transport from collection at PARIDE D’ANGELO until delivery to the address provided.
If a delivery is not collected within the period set by the carrier, the products will be returned to the Owner. The Owner will refund the product price but not the shipping cost. The Owner is not responsible for delivery errors caused by inaccurate or incomplete information in the order, or for shipping delays or damage that occurs after the carrier receives the products where the carrier was chosen and appointed by the User.
Damaged goods
If the courier delivers damaged, broken or wine-stained parcels because bottles have broken, please refuse the shipment and PARIDE D’ANGELO will arrange its return and replacement. If only some parcels are damaged, refuse the damaged parcel and sign the carrier's delivery note "with reservation".
PARIDE D’ANGELO will arrange the return and replacement of the damaged parcel. If the replacement product is out of stock, PARIDE D’ANGELO will contact you promptly about a replacement or refund of the remaining value. Any shipping costs for returning the damaged parcel and delivering the replacement are paid by PARIDE D’ANGELO.
Right of withdrawal and warranty
Right of withdrawal
Under Articles 64 and following of Italian Legislative Decree no. 206 of September 6, 2005, a consumer who purchases products or Services on PARIDE D’ANGELO may withdraw from the Contract without giving a reason within 30 days. The withdrawal period ends 30 days after the day on which the User, or a third party other than the carrier and designated by the User, takes physical possession of the goods.
To exercise this right, the User must inform the Owner of the decision to withdraw by sending an explicit statement to the contact details provided. The withdrawal or refund conditions for purchases by non-consumer Users are agreed between the Owner and User case by case.
Effects of withdrawal
If the User withdraws from this Contract, the Owner will refund all payments received from the User, including delivery costs, except for additional costs arising from a delivery method other than the least expensive standard delivery offered. The refund will be made without undue delay and no later than 14 days from the day the Owner is informed of the User's decision to withdraw.
Refunds are made using the same payment method used for the original transaction unless the User has expressly agreed otherwise. The User will not incur any fee because of the refund. The Owner may suspend the refund until the goods are received or until the User proves that the goods have been sent back, whichever occurs first.
The User must return the goods to the Owner without undue delay and in any case within 14 days from the day on which the User communicated the withdrawal. The deadline is met if the User sends the goods before the 14-day period expires. Return shipping costs are paid by the User. The User is responsible only for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and operation of the goods.
Limitations on withdrawal for products
Returned products that are damaged or used beyond what is strictly necessary to establish their nature, characteristics and operation will be refunded after deducting the reduction in value caused by the damage or use. No refund is available where the reduction in value is total. Please include a copy of the delivery document inside the parcel.
Please return products in their original packaging. The User acknowledges and accepts that some exceptions to the right of withdrawal apply, including:
- the supply of goods that may deteriorate or expire quickly;
- the supply of sealed goods that cannot be returned for hygiene or health protection reasons and were opened after delivery;
- the supply of alcoholic beverages whose price was agreed when the sales contract was concluded, whose delivery can take place only after 30 days and whose actual value depends on market fluctuations beyond the professional's control.
If one of these exceptions applies to the goods purchased, the User cannot exercise the right of withdrawal.
Who may use the withdrawal clauses
The clauses governing withdrawal, its effects and its exceptions apply only to a User who qualifies as a consumer, meaning a User acting for purposes outside their business or professional activity.
Satisfaction guarantee
If one or more bottles you purchased are not to your taste or do not meet PARIDE D’ANGELO quality standards, follow the request procedure described on the "satisfied or refunded" page.
Warranty
A User who purchases as a consumer has a conformity warranty for purchased products for 24 months, provided that defects are reported within 2 months of discovery. To exercise the warranty, the User must contact the Owner using the details in this document and describe the defect accurately.
If a lack of conformity is confirmed, the User may have the product repaired or replaced. The User may also request a suitable price reduction or termination of the Contract when repair or replacement is impossible or excessively costly, when the Owner has not repaired or replaced the product within a reasonable period of at least 15 days, or when a previous repair or replacement caused significant inconvenience.
To exercise the warranty or request further information, the User must contact the Owner.
Compensation and limitation of liability
Indemnity
The User agrees to indemnify the Owner, its controlled or affiliated companies, representatives, directors, agents, licensees, partners and employees against any obligation or liability, including legal fees, arising from damage caused to other Users or third parties in connection with content uploaded online or with a breach of law or these Service conditions.
Limitation of liability
To the extent permitted by applicable law, the Owner is liable to Users or third parties for contractual and non-contractual damage only where it is the immediate and direct consequence of wilful misconduct or gross negligence in PARIDE D’ANGELO's activities.
The User expressly releases and holds the Owner harmless, to the extent permitted by applicable law, from liability for any type of damage or claim by the User or third parties, including direct, indirect, punitive, incidental and special damages, lost profits, lost revenue, loss of data and replacement costs arising from or connected with this Contract.
General provisions
Interruption of the Service
The Owner may add or remove features, or temporarily or permanently suspend or stop providing the Service. If the Service is permanently stopped, the Owner will do what is possible to allow Users to retrieve information hosted by the Owner.
Resale of the Service
Users may not reproduce, duplicate, copy, sell, resell or exploit any portion of PARIDE D’ANGELO or its Services without the Owner's express permission, granted directly or through a specific reseller programme.
Privacy Policy
For information about the use of Personal Data, Users should refer to the PARIDE D’ANGELO Privacy Policy.
Intellectual property
All figurative or word marks on the PARIDE D’ANGELO website, and all other signs, trade names, service marks, word marks, commercial names, illustrations, images and logos relating to PARIDE D’ANGELO, are and remain the exclusive property of the Owner or its licensors. They are protected by applicable trademark laws and international treaties.
All marks and other signs, trade names, service marks, word marks, commercial names, illustrations, images and logos relating to third parties are and remain the exclusive property of those third parties or their successors and are protected by applicable trademark laws and international treaties. The Owner does not own them and is authorised to use or display them on PARIDE D’ANGELO within the agreements made with those third parties and only to provide the Service.
Age requirements
Users state that they are adults under the law applicable to them. Minors may use PARIDE D’ANGELO only with the assistance of a parent or guardian. In no case may children under 13 use PARIDE D’ANGELO.
Changes to these Terms
The Owner may amend these Terms at any time by publishing notice within PARIDE D’ANGELO. If a User continues to use PARIDE D’ANGELO after the changes are published, the User accepts the new Terms without reservation.
Assignment of the Contract
The Owner may transfer, assign, novate or subcontract all or some of the rights or obligations arising from these Terms, provided that the User's rights under these Terms are not harmed. The User may not assign or transfer their rights or obligations under these Terms without the Owner's written authorisation.
Communications
All communications relating to PARIDE D’ANGELO must be sent using the contact details provided.
Severability
If any clause of these Terms is invalid or ineffective, that clause will be removed and the remaining clauses will not be affected and will remain effective.
Applicable law and jurisdiction
These Terms and all disputes about the performance, interpretation and validity of this Contract are subject to the law and jurisdiction of the State and to the exclusive jurisdiction of the court where the Owner is based. The consumer's exclusive forum applies where required by law.
Dispute resolution
Online dispute resolution for consumers
Consumers resident in Europe should know that the European Commission has created an online platform for alternative dispute resolution. European consumers may use it to resolve out of court disputes relating to or arising from online contracts for the sale of goods and services. The platform is available through this link. The Owner will answer questions sent by email to the address published in this document.
